As a third-generation realtor, Mark Penner grew up surrounded by the sound of beepers and shoptalk. Now many years into his own thriving career, Penner is Consulting Partner/Co-owner at Royal LePage Prime and one of the most recognizable faces in the Winnipeg real estate industry. It’s all about transparency. The provincial Real Estate Services Act (RESA) stipulates that any buyers or sellers of residential or commercial properties are required to sign an agreement with a Realtor® prior to any services being rendered. This is known as a Service Agreement.

 
 
  • The following are examples of real estate services that require a written Service Agreement to first be in place between you and a Realtor:


    -advising on the appropriate price and terms for a transaction to buy or sell real estate and representing a seller in offering a property for sale

    -representing a landlord seeking to rent premises to a tenant or representing a prospective tenant seeking premises to rent

    -representing a prospective buyer in the potential purchase of real estate and/or providing instructional material pertaining to advertising and the showing of real estate to potential purchasers to assist a person to sell real estate

    -showing property to a prospective buyer or tenant

    -making representation about a property

    -presenting offers to purchase or rent to an owner and advertising the sale or arranging for advertising to assist a person to sell real estate

    -promoting or showing the real estate to prospective tenants or negotiating, or offering to attempt to negotiate a rental or lease agreement

  • -the identification of the parties

    -a description of the services to be provided

    -the dates of commencement and expiry of the agreement

    -any early termination rights of either party before expiry of the agreement

    -any terms of payment or compensation to the brokerage

    -each service agreement must be signed by a representative of the brokerage and by the person to receive the services

    -A copy must be given without delay to the person to receive the services after it is signed
